Terms and Conditions (T&C)

1. Scope of Application  

These Terms and Conditions apply to all contracts between MARYNA MARII KOSMETIK STUDIO and its customers concluded via www.mareyshop.ch.  

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.  

An entrepreneur is any natural or legal person acting in the course of their commercial or independent professional activity.  

Deviating terms of the customer shall only apply if expressly accepted in writing.

3. Offers and Conclusion of Contract  

The presentation of products does not constitute a binding offer.  

By placing an order, the customer submits a binding offer.  

The contract is only concluded upon:  

• explicit order confirmation via e-mail  

• dispatch of the goods  

The automatic order confirmation does not constitute acceptance.  

The provider reserves the right to reject orders without stating reasons.  

4. Prices and Payment Terms  

All prices are stated in CHF and include statutory VAT where applicable.  

Shipping costs are stated separately.  

Payment is made via:  

• TWINT  

• Credit and debit cards (Visa, Mastercard, American Express)  

• Apple Pay  

• Google Pay  

• Other payment methods supported by Stripe  

• Invoice (if approved)  

Payment processing is carried out via the payment service provider Stripe.  

Payments are considered completed only upon irrevocable receipt of funds in the provider’s account.  

The provider reserves the right to exclude certain payment methods.  

In case of late payment:  

• default interest of 5% per annum  

• reminder fee up to CHF 10 per reminder  

• legal action may be initiated  

The provider is entitled to withhold deliveries until full payment is received.  

5. Retention of Title  

The goods remain the property of the provider until full payment of all claims arising from the business relationship has been made.  

The customer is not entitled to resell or pledge the goods before full payment has been made.  

6. Delivery and Transfer of Risk  

Delivery is made to the address specified by the customer.  

Upon handover of the goods to the transport company, the risk of accidental loss or deterioration passes to the customer.  

This also applies to shipments without tracking or additional insurance.  

The provider is not liable for delays or damages caused by the transport company.  

Delivery times are non-binding unless expressly agreed otherwise in writing.  

Partial deliveries are permitted.  

For international deliveries, the customer bears all customs duties and import taxes.  

The customer is responsible for complying with the import regulations of their country.  

7. Inspection Obligation and Notification of Defects  

The customer must inspect the goods immediately upon receipt.  

Obvious defects must be reported in writing to info@mareyshop.ch within 7 days at the latest.  

If no timely notification is made, the goods shall be deemed approved.  

8. Warranty  

Statutory warranty rights under Swiss law apply.  

The warranty period is:  

• 12 months for new goods  

• exclusion for used goods where legally permissible  

No warranty applies in cases of:  

• normal wear and tear  

• improper use  

• third-party interference  

• external influences  

9. Use of Products  

The products offered are intended exclusively for professional use.  

The customer is obliged to use the products properly and in accordance with professional standards.  

The customer is solely responsible for possessing the necessary professional knowledge to use the products.  

The provider assumes no liability for damages resulting from improper use.  

10. Liability  

The provider is liable only for damages caused intentionally or through gross negligence.  

The provider assumes no liability for individual intolerance reactions or allergic reactions, unless caused by intentional or grossly negligent conduct.  

In the event of a breach of essential contractual obligations, the provider shall also be liable for slight negligence, but limited to the foreseeable, typically occurring damage.  

Liability for:  

• indirect damages  

• consequential damages  

• loss of profit  

is excluded.  

Mandatory statutory liability provisions remain unaffected.  

11. Right of Withdrawal (Voluntary Returns)  

There is no statutory right of withdrawal under Swiss law.  

The provider voluntarily grants a return period of 14 days.  

Conditions:  

• unused goods  

• original packaging  

• complete return  

Return shipping costs are borne by the customer.  

Refunds are issued within 14 days after receipt of the returned goods using the original payment method.  

12. Data Protection  

Personal data is processed in accordance with the privacy policy available at:  

www.mareyshop.ch/privacy  

13. Force Majeure  

The provider shall not be liable for failure or delay in the performance of obligations due to events of force majeure beyond its control.  

14. Severability Clause  

If any provision is found to be invalid, the validity of the remaining provisions shall remain unaffected.  

15. Applicable Law and Jurisdiction  

Swiss substantive law shall apply exclusively, excluding conflict-of-law rules.  

The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.  

For entrepreneurs, the exclusive place of jurisdiction is Laufen (BL).  

For consumers, the mandatory statutory places of jurisdiction apply.
